IN ADDITION, SEARS HAS AN OWNERSHIP INTEREST IN THE SENSE THAT THEY ARE MEMBERS AND PARTIES TO RECIPROCAL EASEMENT AGREEMENTS AND OPERATING AGREEMENTS BETWEEN NOT ONLY THE APPLICANT TODAY BUT ALSO THEY'RE PARTY TO THESE RECIPROCAL AGREEMENTS WITH ALL THE OTHER OWNERS OR INTERESTED PARTIES IN THE SHOPPING CENTER. FOR EXAMPLE, THERE ARE OTHER ANCHORS THERE, OTHER OPERATORS, OTHER STORE OWNERS WHICH ARE PARTIES TO THESE AGREEMENTS. SEARS CANNOT SUPPORT THIS ZONING APPLICATION DUE TO THE FACT THAT IT IS -- IT LACKS SUFFICIENT DETAIL AND IS VAGUE IN THE SENSE THAT SEARS CANNOT DETERMINE WHETHER THERE ARE ANY IMPACTS AS -- THE USES THAT ARE ANTICIPATED ON THE PROPERTY HAVE A NEGATIVE IMPACT ON THEM OR NOT. FOR EXAMPLE, WHEN YOU LOOK AT THE APPLICATION, THE BROAD USES THAT ARE IN THERE, SEARS CANNOT DETERMINE WHETHER, FOR EXAMPLE, IF THEY'RE GOING TO GO WITH MULTIFAMILY USES. IT SEEMS THAT THAT WOULD HAVE A NEGATIVE IMPACT ON A REGIONAL MALL. IN ADDITION -- OR, YOU KNOW, CONVERSELY, IF THERE'S DETAIL SHOWING ADDITIONAL RETAIL USES OR OTHER USES THAT ARE MORE COMPATIBLE WITH A REGIONAL MALL, THAT'S SOMETHING THAT SEARS, IF PRESENTED WITH, PROBABLY WOULD SUPPORT, SO THE PROBLEM WITH THE APPLICATION, THE AMBIGUITY COMES IN IS IT REALLY LACKS DETAIL AND IS VAGUE TO THE POINT THAT SEARS AS AN OWNER CANNOT MAKE A DETERMINATION AT THIS TIME WITH WHAT HAS BEEN APPLIED FOR AS TO WHETHER IT NEGATES OR HAS A NEGATIVE IMPACT ON THEIR CURRENT OPERATIONS AND CURRENT RIGHTS NOT ONLY AS A NEIGHBOR BUT ALSO AS A PARTY TO THE AGREEMENTS THAT ARE IN PLACE AT THIS TIME. WE HAVE MADE -- WHAT'S GOING ON IS THE OWNERS OF THE MAJORITY OF THE MALL, THE PIECES THAT ARE IN THE PD, WOULD LIKE TO TRY TO ENHANCE THE ACTIVITY IN THE MALL, MAKE IT MORE VITAL, MAKE IT MORE VIABLE, MAKE IT MORE OF A PART OF THAT COMMUNITY. THEY ARE VERY ACTIVE WORKING ON THE 22nd AVENUE NORTH ACTIVITIES AND IMPROVEMENTS. THEY'VE BEEN COOPERATING, WORKING ON THE TASK FORCES, GIVING UP EASEMENTS AND LAND AND THINGS TO MAKE THAT HAPPEN. THEY'RE ALSO WORKING WITH THE TRANSIT ALONG FOWLER, SO THEY'VE BEEN VERY ACTIVE. THEY'RE TRYING TO MAKE THIS MORE VITALIZED. IF YOU'VE BEEN UP TO THE MALL RECENTLY, IT'S HURTING, AND WE'RE TRYING TO MAKE IT NOT HURT. THERE'S NO INTENTION OF TAKING THE MALL APART. WHAT THE INTENTION IS, TO GET A FLEXIBLE PD IN BECAUSE THIS IS A MIXED USE-20, YOUR MOST INTENSE LAND USE CATEGORY IN ONE OF YOUR MOST INTENSELY DEVELOPED AREAS WITH THE UNIVERSITY AND THE HOSPITALS AND EVERYTHING, TO TRY TO INTEGRATE ALL OF THIS, TO PROVIDE OPPORTUNITIES -- IF SOMETHING COMES UP, UNIVERSITY, THE START -- THE VA NEEDED A FACILITY. WHEN SOME THINGS COME UP THAT MAKE SENSE THAT CAN BE PUT ON THE MALL PROPERTY, NOT INSIDE THE MALL BUT ON THE MALL PROPERTY, THAT MAKE SENSE AND ENHANCE THE WHOLE AREA AND EVERYBODY IS GETTING BETTER INTERNAL CAPTURE -- YOU HAVE PEOPLE LIVING OR -- NEAR OR BY THE MALL SITE COMING ON AND OFF BY FOOT, WE RUN TRANSIT TO THE VA AND TO THE UNIVERSITY RIGHT NOW AT OUR COST TO SERVICE THAT, SO WE NEED TO HAVE THIS VAGUE SO WE CAN RESPOND TO THINGS AS THEY COME UP. WE KNOW WE HAVE REAs. WE ABSOLUTELY KNOW AND HAVE PUT IN THE RECORD BEFORE AT THE ZONING MASTER WE HAVE GOT TO BE CONSISTENT WITH THE REAs, BUT THE PROBLEM IS WE CAN'T GO AMEND THE REAs UNTIL WE KNOW WHAT WE WANT TO BUILD, AND WE DON'T KNOW WHAT WE WANT TO BUILD UNTIL WE HAVE THE RIGHT TO BUILD IT, SO IT'S REALLY A CATCH 22. WHAT WE NEED TO DO IS GET THE ZONING, GET A PROJECT PLANNED SO WE CAN SHOW WHERE IT'S GOING TO BE, WHAT IT'S GOING TO LOOK LIKE, AND THEN TAKE IT TO SEARS AND ALL THE OTHER OWNERS AND GET THE REAs MODIFIED TO ALLOW THAT USE. THAT'S THE WAY WE WANT TO PROCEED, THAT'S THE WAY WE WILL PROCEED, BUT TO DO IT THE OTHER WAY AROUND REALLY DOESN'T MAKE SENSE FOR THE DEVELOPER OR THE COUNTY BECAUSE WE WOULD HAVE TO GO FIND A DEVELOPER WHO WANTED TO BUILD SOMETHING, SAY WAIT TWO YEARS WHILE I GO BACK AND SPEND A YEAR MODIFYING THE REAs AND THEN SPEND EIGHT MONTHS ZONING IT. YOU KNOW, STICK AROUND, SEE WHAT HAPPENS. WE'VE GOT TO DO IT THE OTHER WAY. SO ANYWAY, THAT'S THE ONLY REASON WHY WE HAVE -- WE'RE AT A DIFFERENCE OF OPINION WITH SEARS. IT'S JUST A TIMING ISSUE. IT'S IN THE URBAN SERVICE AREA AND IN THE UNIVERSITY ARE COMMUNITY PLAN AREA. THE RANGE OF USES THAT IS BEING PROPOSED IS CONSISTENT WITH THE LAND USE CATEGORIES. IT'S ONE OF OUR MOST INTENSIVE LAND USE CATEGORIES AND AN INTENSIVE AREA WHERE WE HAVE A LOT OF FOCUS FOR REDEVELOPMENT. THE PROPOSED RANGE OF USES WOULD ALLOW THEM TO POTENTIALLY TAKE ADVANTAGE OF SOME INCENTIVES IN THE COMPREHENSIVE PLAN FOR A GREATER MIX OF USES, AND BASED ON ALL OF THIS, THE PLANNING COMMISSION STAFF FOUND THE PROPOSED REZONING CONSISTENT WITH THE COMPREHENSIVE PLAN. THANK YOU. >>KEN HAGAN: HEARING MASTER. >>ADAM GORMLY: THE HEARING MASTER FOUND THAT THE EXISTING MALL SITE IS RECOGNIZED AS A REGIONAL ACTIVITY IN CENTRAL HILLSBOROUGH COUNTY AND THAT IT IS ALSO SERVED BY ARTERIAL AND COLLECTOR ROADWAYS, MASS TRANSIT, AND HAS A HARTLINE TRANSFER CENTER. HE FOUND THAT PROVIDING FOR FLEXIBILITY TO THE MALL OWNERSHIP WILL ENHANCE THE POSSIBILITY FOR THE LONG-TERM SUCCESS OF THIS REGIONAL ATTRACTION AND DID RECOGNIZE THAT THERE ARE FOUR PARCELS THAT ARE OWNED BY ANCHOR DEPARTMENT STORES, INCLUDING SEARS, THAT OWN THEIR OWN BUILDINGS AND WERE NOT PART OF THIS REZONING. HE DID ALSO RECOGNIZE THAT AS IS CUSTOMARY FOR REGIONAL MALLS, THERE ARE PRIVATE RECIPROCAL EASEMENT AGREEMENTS REGARDING MATTERS SUCH AS PARKING, STORMWATER, UTILITIES, AND OTHER RELATED OPERATIONAL MATTERS AND THAT THOSE AGREEMENTS WERE NOT WITHIN THE COUNTY'S PURVIEW FOR ENFORCEMENT BUT ALSO -- BUT HE DID FIND THAT ANY REDEVELOPMENT ACTIVITY AT THE MALL COULD BE ADDRESSED BY THE COUNTY STAFF THROUGH THE SITE DEVELOPMENT PROCESS TO ENSURE NO ADVERSE IMPACTS TO ADJACENT PROPERTY OWNERS. HE ALSO DID SUPPORT THE REDUCTION IN OPEN SPACE FROM 20% TO 10% IN THE EVENT THAT THERE ARE THREE USES ON THE SITE AND FOUND THAT THE PD WOULD BE COMPATIBLE WITH THE SURROUNDING LAND USES AND CONSISTENT WITH THE EXISTING ZONING PATTERN IN THE AREA AND RECOMMENDED APPROVAL. >>KEN HAGAN: THANK YOU.
